These Terms of Service ("Terms") govern your access to and use of the Deviance website (dev1ance.com), the private Discord community and any 1-on-1 mentorship sessions (together, the "Service"). By signing up, paying or using any part of the Service you accept these Terms.
1. What Deviance is
Deviance is an educational mentorship service focused on futures trading. It is operated by a single individual based in the European Union. The Service includes access to a private Discord, educational content, and 1-on-1 mentorship sessions.
2. Educational nature & no financial advice
Deviance does not provide investment, financial, legal or tax advice. Nothing inside the Service constitutes a recommendation to buy, sell or hold any financial instrument. Deviance is not a registered investment advisor, broker-dealer or financial planner. Every trading decision you make is your own.
3. No guaranteed results
Trading futures, options and other leveraged instruments involves substantial risk of loss and is not suitable for every investor. Past performance of mine or of any student is not indicative of your future results. You may lose part or all of the capital you commit to evaluations or to your own accounts.
4. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts in your country of residence. By using the Service you represent that you meet these requirements.
5. Pricing & payment
- Monthly plan: €249 per month, recurring until cancelled.
- Lifetime plan: €997 one-time payment.
All payments are processed by Stripe. Prices are in Euro and exclude any local taxes, which may be added at checkout depending on your location.
6. Cancellation & refunds
- Monthly plan: you can cancel at any time from the Stripe customer portal. Access remains active until the end of the current billing cycle and no refund is issued for the unused portion.
- Lifetime plan: because access to the model and to private materials is granted immediately after payment and NDA signing, the lifetime plan is non-refundable.
- Mandatory consumer-protection rights you may have under the law of your country are unaffected.
7. NDA & confidentiality
Before accessing the private materials and Discord, you are required to sign a Non-Disclosure Agreement. The model, training videos, trade reviews and any other proprietary content shared inside Deviance are confidential. You agree not to share, resell, redistribute or publicly disclose any part of the content, whether for free or for profit, during or after your access.
Breach of the NDA results in immediate termination of access without refund and may give rise to civil claims for damages.
8. Acceptable use inside Discord
You agree to behave respectfully toward other members. The following are grounds for warning and, if repeated, termination without refund:
- Harassment, hate speech or personal attacks.
- Sharing copyrighted or NDA-protected material.
- Selling, promoting or referring competing services.
- Scamming, impersonating staff or evading bans.
9. Termination
I may suspend or terminate your access at any time for material breach of these Terms, breach of the NDA, fraudulent payments or conduct that harms the community. You may stop using the Service and cancel your subscription at any time.
10. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy or non-infringement.
11. Limitation of liability
To the maximum extent permitted by applicable law, the total aggregate liability of Deviance arising out of or in connection with these Terms or the Service is limited to the amount you paid for the Service during the 12 months preceding the event giving rise to the claim. Deviance is not liable for indirect, incidental, special or consequential damages, including loss of profits or trading losses.
12. Governing law & jurisdiction
These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. Any dispute arising from or related to the Service shall be subject to the exclusive jurisdiction of the courts of the city of residence of the operator, unless mandatory consumer-protection law grants you a different jurisdiction.
13. Changes to these Terms
I may update these Terms from time to time. The "Last updated" date reflects the latest revision. Material changes will be communicated by email or via the site. Continued use after a change constitutes acceptance of the new Terms.
